§ 1Short title and commencement

(1)This Act shall be called the Bangladesh Technical Education Board Act, 2018.

(2)It shall come into force immediately.

§ 2Definitions

In this Act, unless there is anything repugnant in the subject or context,

(1)"Board" means the Bangladesh Technical Education Board established under section 3;

(2)"Chairman" means the Chairman of the Board;

(3)"Member" means a member of the Board and includes the Chairman;

(4)"President" means the President of Bangladesh;

(5)"Government" means the Government of the People's Republic of Bangladesh;

(6)"Technical Education" means education in engineering, technology, agriculture, medicine, commerce, textile, fisheries, and other technical and vocational subjects;

(7)"Technical Institution" means any institution imparting technical education.

§ 3Establishment of the Board

(1)There shall be established a Board called the Bangladesh Technical Education Board.

(2)The Board shall be a body corporate having perpetual succession and a common seal, and may sue and be sued in its own name.

§ 4Office of the Board

The head office of the Board shall be in Dhaka, and the Board may, with the prior approval of the Government, establish branch offices at other places in Bangladesh.

§ 5Composition of the Board

(1)The Board shall consist of the Chairman and such number of members as the Government may determine by notification in the official Gazette.

(2)The Chairman and members shall be appointed by the Government from among persons having knowledge and experience in technical education, industry, or administration.

§ 6Term of office

(1)The Chairman shall hold office for a term of 3 years from the date of his appointment.

(2)A member, other than an ex-officio member, shall hold office for a term of 3 years.

(3)The Chairman or a member may resign by writing under his hand addressed to the Government.

§ 7Removal from office

The Government may remove the Chairman or any member from office if he-
(a) is adjudged insolvent; or
(b) is convicted of an offence involving moral turpitude; or
(c) is found to be physically or mentally unfit; or
(d) is guilty of misconduct or neglect of duty.

§ 8Meeting of the Board

(1)The Board shall meet at least once every month.

(2)The Chairman shall preside over the meetings of the Board.

(3)The quorum for a meeting shall be one-third of the total number of members.

(4)Decisions of the Board shall be taken by majority vote of the members present, and in case of equality of votes, the Chairman shall have a casting vote.

§ 9Functions of the Board

The Board shall perform the following functions, namely:-
(a) prescribe curricula and syllabi for technical and vocational education;
(b) arrange and conduct examinations;
(c) award certificates, diplomas, and degrees;
(d) affiliate technical institutions;
(e) advise the Government on matters relating to technical education;
(f) perform such other functions as may be prescribed.

§ 10Powers of the Board

The Board may, for the purpose of carrying out its functions,-
(a) enter into contracts;
(b) acquire, hold, and dispose of property;
(c) appoint teachers and other staff;
(d) levy fees and charges;
(e) borrow money with the prior approval of the Government;
(f) do all such other acts and things as may be necessary for the discharge of its functions.

§ 11Constitution of Committees

(1)The Board may constitute such number of committees as it considers necessary to assist it in the discharge of its functions.

(2)Without prejudice to the generality of sub-section (1), the Board shall have the following committees, namely:-
(a) Academic Committee;
(b) Examination Committee;
(c) Finance Committee;
(d) Affiliation Committee;
(e) such other committees as the Board may determine.

§ 12The Chairman

(1)The Chairman shall be the chief executive officer of the Board.

(2)The Chairman shall be responsible for the overall administration and management of the affairs of the Board.

(3)The Chairman may delegate any of his powers to a member or an officer of the Board.

§ 13Secretary and other officers

(1)The Board shall have a Secretary appointed by the Government.

(2)The Board may, with the prior approval of the Government, appoint such other officers and employees as may be necessary for the efficient performance of its functions.

§ 14Appointment of teachers and staff

The Board may appoint teachers and other staff for technical institutions in accordance with the prescribed terms and conditions of service.

§ 15Formation of Committees

(1)For the purposes of this Act, the Board may form such number of committees as may be necessary.

(2)Without prejudice to the generality of sub-section (1), the Board shall have the following committees, namely:-
(a) Diploma Courses of Studies Committee;
(b) Certificate Courses of Studies Committee;
(c) Finance Committee;
(d) Appointment Committee;
(e) such other committees as the Board may determine.

§ 16Fund of the Board

(1)The Board shall have a Fund called the Bangladesh Technical Education Board Fund.

(2)The following shall be credited to the Fund, namely:-
(a) grants and loans from the Government;
(b) fees and charges received by the Board;
(c) income from property and investments;
(d) donations and bequests;
(e) all other sums received by the Board.

§ 17Application of the Fund

The Fund shall be applied towards payment of salaries, allowances, and other expenses of the Board and for meeting all other expenditures incurred under this Act.

§ 18Budget

The Board shall, for each financial year, prepare a budget of its estimated income and expenditure and submit it to the Government for approval.

§ 19Accounts and audit

(1)The Board shall maintain proper accounts and records in the prescribed manner.

(2)The accounts of the Board shall be audited annually by the Comptroller and Auditor General of Bangladesh or by an auditor appointed by him.

§ 20Annual Report

The Board shall, within 6 months after the close of each financial year, submit an annual report to the Government on its activities during that year.

§ 21Power to make regulations

The Board may, with the prior approval of the Government, make regulations for carrying out the purposes of this Act.

§ 22Power to make rules

The Government may, by notification in the official Gazette, make rules for carrying out the purposes of this Act.

§ 23Directions by the Government

The Government may give such directions to the Board as it considers necessary in the public interest, and the Board shall be bound to comply with such directions.

§ 24Power to inspect

The Government may, at any time, cause an inspection to be made of the affairs of the Board by such person or persons as it may appoint.

§ 25Delegation of powers

The Board may, by general or special order, delegate any of its powers to the Chairman or any member or officer of the Board.

§ 26Immovable property

The Board may, with the prior approval of the Government, acquire, hold, lease, sell, or otherwise transfer any immovable property.

§ 27Exemption from taxes

Notwithstanding anything contained in any other law for the time being in force, the property and income of the Board shall be exempt from all taxes, rates, and duties.

§ 28Protection of acts done in good faith

No suit, prosecution, or other legal proceeding shall lie against the Government, the Board, the Chairman, any member, or any officer or employee of the Board for anything done in good faith under this Act.

§ 29Repeal and savings

(1)The Technical Education Act, 1967 (East Pakistan Act No. 1 of 1967) is hereby repealed.

(2)Notwithstanding such repeal, anything done or any action taken under the repealed Act shall be deemed to have been done or taken under this Act.

§ 30Authentic English Text

(1)After this Act comes into force, the Government shall, by notification in the official Gazette, publish a reliable English translation (Authentic English Text) of the original Bengali text of this Act.

(2)In the event of conflict between the Bengali and English texts, the Bengali text shall prevail.
